These Terms of Service (“Terms”) govern your access to and use of the Saleswise website, software, and related services (collectively, the “Services”) provided by Saleswise (“we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Saleswise provides tools and content intended for real estate professionals. Features, availability, and pricing may change over time. We may modify, suspend, or discontinue any part of the Services with reasonable notice where practicable.
You may need to create an account to access certain features. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of any unauthorized use.
You agree not to misuse the Services, including by attempting to gain unauthorized access, interfering with operation, scraping in violation of our policies or applicable law, uploading malicious code, or using the Services in a manner that violates law or infringes others’ rights.
The Services, including software, text, graphics, logos, and branding, are owned by Saleswise or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes.
You retain ownership of content you submit to the Services. You grant us a license to use, host, and process that content as needed to provide and improve the Services, consistent with our Privacy Policy.
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific business outcomes or accuracy of outputs from automated or AI-assisted features.
To the fullest extent permitted by law, Saleswise and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Services. Our aggregate liability for claims arising from the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100), except where prohibited by law.
You agree to defend and indemnify Saleswise and its affiliates against claims arising from your use of the Services, your content, or your violation of these Terms, to the extent permitted by law.
Subscriptions and trials. If you purchase a paid subscription, fees are billed according to the plan you select. Trial terms, if offered, will be presented at signup.
Refund requests. If you are not satisfied with a paid subscription, you may request a refund by contacting us through the contact page within fourteen (14) days of your initial payment for that subscription period. We will review good-faith requests and, where approved, issue a refund to the original payment method within a reasonable time (typically within ten (10) business days after approval, depending on your payment provider).
Non-refundable amounts. Refunds generally do not apply to: (a) periods beyond the 14-day window from the initial payment for the current term; (b) renewals after you have had a prior opportunity to cancel; (c) fees for third-party services or add-ons billed separately; (d) accounts terminated for violation of these Terms; or (e) amounts required to be withheld by law or payment network rules.
Cancellations. You may cancel your subscription according to the cancellation method shown in your account or billing communications. Cancellation stops future charges; it does not automatically refund prior charges outside the refund policy above.
We may suspend or terminate access to the Services if you materially breach these Terms or if we are required to do so by law. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.
These Terms are governed by the laws of the State of Texas, United States, excluding conflict-of-law rules, except where mandatory local law provides otherwise.
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Material changes may be communicated through the Services or by email where appropriate. Continued use after the effective date of changes constitutes acceptance unless applicable law requires otherwise.
